This Privacy Policy is intended to describe the management methods of the second and third level website, newsletters and services (hereinafter “Services”) owned and managed by the company Viba SpA (hereinafter “VIBA”) , with reference to the processing of personal data of users/visitors who consult them and/or who are registered.

Viba processes all personal data of users/visitors of the services offered, in full compliance with the provisions of the Italian national legislation on privacy and, in particular, with Legislative Decree 196/2003.

1) To use the Services offered by VIBA, it may be required to fill in the registration form, containing fields for the provision of compulsory and optional personal data. The provision of personal data indicated as mandatory is necessary to complete the registration procedure; therefore the failure or partial provision of such data makes it impossible to subscribe to the Services and use them. The provision of non-mandatory data is optional; therefore their failure or partial provision does not prevent you from registering and using the Services. The personal data requested by VIBA for registering for the Services may differ according to the registration forms used.

2) VIBA keeps the technical data relating to the connections (log) to allow for the security checks required by law and in order to improve the quality of the services offered and customize them in relation to the needs of the users/visitors. VIBA provides, in accordance with the current provisions of the law on the subject, the recording of log files. These data do not allow user identification except following a series of processing and interconnection operations, and necessarily through data provided by other providers. Operations that may be carried out exclusively at the request of the competent Judicial Authorities, authorized to do so by express provisions of the law aimed at preventing and/or repressing crimes. On the VIBA websites, temporary markers (cookies) are used which allow you to access the site faster. By cookie we mean information data, active for the duration of the connection, which is transmitted by VIBA to the user’s computer in order to allow rapid identification. The user can disable cookies by changing the browser settings, we warn that this deactivation may slow down or prevent access to all or part of the site. The sending by users/visitors of their personal data to access certain services, or to make requests by e-mail, involves the acquisition by VIBA of the sender’s address and/or any other personal data, such data will be processed exclusively to respond to the request, or for the provision of the service, and will be communicated to third parties only if it is necessary to comply with the requests of the users / visitors themselves.

3) Subject to freely expressed consent, explicitly and in a differentiated form with respect to the various processing purposes, by selecting the “Yes” box present in the registration forms for the Services, personal data may be processed for sending information by e-mail commercial, advertising and promotional material relating to VIBA Services and/or third party services or products selected on the basis of the data provided in the relevant registration form. Consent for the processing purposes referred to in this point 3) is optional; therefore, following a possible refusal, the data will be processed only for the purposes indicated above. It will also be possible after registration, automatically and without costs, to oppose the processing of data and not to receive promotional and/or commercial communications, maintaining the registration for the Services, by clicking on the appropriate link at the bottom of the page in all communications advertisements sent by VIBA.

4) Personal data, collected and stored in VIBA databases, are processed by employees and/or collaborators of the data controller as persons in charge. They are not subject to dissemination or communication to third parties, except in the cases provided for by the information and/or by the Law and, in any case, with the methods permitted by this.

5) The treatment is carried out through automated tools for the time strictly necessary to achieve the purposes for which the data were collected and, in any case, in compliance with the regulatory provisions in force on the matter. Specific security measures are observed to prevent data loss, illicit or incorrect use and unauthorized access. VIBA cannot be held responsible for any unauthorized access or loss of personal information beyond its control.

6) The data controller is Viba SpA, registered office in Via Mantova, 2 – 21049 Tradate (Varese) which may use them for all the purposes identified in this disclosure. Users/visitors have the right to exercise the rights provided for by art. 7 of D. Lgs. 196/03. At any time by sending the request by post, fax or email to the following address privacy@vibamasterbatch.com, moreover, by exercising the right of withdrawal from all the subscribed services, it is possible to request the total cancellation of the data provided.

7) Right of access to personal data and other rights pursuant to article 7 of the Privacy Code:

1. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form.

2. The data subject has the right to obtain the indication:

(a) of the origin of personal data;

(b) of the purposes and methods of processing;

(c) of the logic applied in the case of processing carried out with the aid of electronic instruments;

(d) of the identification details of the owner, managers and designated representative under Article 5, paragraph 2;

e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representative in the territory of the State, managers or appointees.

3. The data subject has the right to obtain:

(a) updating, rectification or, when interested, supplementation of data;

(b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;

(c) certification that the transactions referred to in subparagraphs. (a) and (b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except where this proves impossible or involves the use of means manifestly disproportionate to the right protected.

4. The data subject has the right to object, in whole or in part:

a) for legitimate reasons to process personal data concerning him/her, even if relevant to the purpose of collection;

b) to the processing of personal data concerning him/her for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication;
